Terms of Service
Memories Drop is a service provided by Stateless d.o.o. (“we”, “our”, or “the Company”). These terms govern your use of Memories Drop (“the service”). By creating an event, purchasing a package, or uploading content, you agree to these terms.
1. The Service
Memories Drop provides a technical platform for private event galleries. You create an event page with a unique URL and QR code; guests scan the code to upload photos, videos, or short audio clips, which appear in a shared gallery.
The roles: you, the Organiser, decide who receives the event link and how the gallery is used. We provide the infrastructure and process the media as described in these terms and our Privacy Policy.
Responsibility: you are responsible for managing access to your event page and taking reasonable steps to ensure your guests use the service lawfully and respectfully.
2. Access & Security — The Manage Link
Access to your dashboard is provided via a Manage Link emailed to you at checkout.
Security: you are responsible for keeping this link secure and for not sharing it with unauthorised people. Anyone with this link can view, download, or delete media.
Recovery: if you lose your link, contact support@memoriesdrop.com from the email address used at checkout.
3. Retention and Downloads
Retention period: uploaded media is retained for the retention period purchased with your event — 3, 6, or 12 months — counted from the first upload to your event. Events purchased before 22 July 2026 keep the 6-month retention period that applied at the time of purchase.
Deletion: after this period, the event and its media may be permanently deleted.
Your responsibility: we strongly recommend you download your media before the retention period ends. After the retention period expires, we are not responsible for preserving or recovering deleted media.
4. User Content and Acceptable Use
You agree not to upload, host, or share content that is illegal, infringes intellectual property, violates privacy rights, contains child sexual abuse material (CSAM), promotes terrorism, violence, or hatred against protected groups, contains malware or attempts to compromise the service, or is intended to harass, stalk, or threaten others.
Sensitive media: please do not upload media that reveals sensitive personal information, such as health information, religious or political beliefs, or other sensitive traits, unless you have the necessary permission and a lawful basis to do so.
Minors: where media includes minors, organisers and guests are responsible for ensuring they have appropriate permission to share that media, especially where the content is sensitive.
Reporting: to report illegal content or privacy violations, email support@memoriesdrop.com. Please include the event link, a description of the content, the reason for the report, and your contact email. We may remove or disable access to reported content while we review a report.
5. Content Ownership and Licence
Ownership: you and your guests retain all rights to the photos, videos, audio clips, and other media you upload.
Our licence: you grant us a limited, non-exclusive licence to host, store, process, display, and make the media available for download solely for the purpose of operating the service for you and your guests.
Our promise: we do not sell your data or use your content for marketing or AI model training.
6. Payments and Refunds
Payments are handled by Lemon Squeezy. As Merchant of Record, Lemon Squeezy handles payment processing, invoices, and applicable tax compliance.
Withdrawal right: by purchasing, you request that we begin providing access to the service immediately, and you acknowledge that the statutory right of withdrawal is lost once the service has been used (media has been uploaded to your event).
Refund policy: we offer a full refund within 14 days of purchase if the event has not been used and no media has been uploaded. Once media has been uploaded or the event date has passed, refunds may be refused except where required by law or in cases of a material technical failure on our side that prevented you from using the service. To request a refund, email support@memoriesdrop.com.
7. Service Availability
We aim to keep the service available, but we do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, security updates, or abuse-prevention reasons. We will use reasonable efforts to give advance notice of planned downtime.
8. Limitation of Liability
The service is provided “as is”. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the service in the 12 months prior to the claim. We are not liable for indirect or consequential damages, including loss of data. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Termination
You may delete your event at any time via your Manage Link.
We may terminate your access immediately if you violate these terms or if the event is used for abusive, unlawful, or security-risk purposes.
Upon termination, we will delete or disable access to the media within 30 days, except where retention is required by law or where copies remain temporarily in encrypted backups.
10. Changes to These Terms
We may update these terms from time to time. We will update the “Last updated” date and, where changes materially affect active events, notify organisers by email.
11. Governing Law
These terms are governed by the laws of the Republic of Croatia. The competent courts of Split shall have non-exclusive jurisdiction, without prejudice to mandatory consumer-protection rights in your country of residence.
